However, the court of first instance imposed a penalty disproportionate to the damage caused. The prosecutor's office intervened. By a ruling of the appellate court, the subsoil user's actions were reclassified under Part 2 of Article 139 of the Code of Administrative Offenses of the Republic of Kazakhstan (Violation of state property rights to subsoil).
"The guilty person was subjected to an administrative penalty in the form of a fine with confiscation to the state of the truck used to transport illegally extracted natural resources," the prosecutor's office noted.
Earlier, Kursiv reported that Tokayev criticized subsoil users in Alatau. According to him, about 30 business entities in the region do not comply with basic environmental legislation requirements and industrial safety standards.
