A resident of the Mangystau Region has secured reinstatement in the housing queue after six years; he had been removed due to a change of registration. The court ruled that the actions of the Zhanaozen housing and utilities department were unlawful. This was reported by Qazaqyia.kz citing Kursiv Media.
According to the court's press service, the man lost his parents early and was raised in a regional orphanage from 2002 to 2013. On 7 December 2009, he was registered as needing housing under the "orphan children" category.
By the beginning of 2018, he was 21st in the queue. However, in 2020, officials removed the man from the list, citing a change in his permanent registration address.
The orphan went to court and demanded the restoration of his previous place. During the proceedings, it emerged that the law prohibited removing such citizens from the register until they were provided with housing.
"When the plaintiff was removed from the register of those in need of housing in 2020, he belonged to the category of citizens who, in accordance with legal requirements, were not subject to removal from the register," the court explained.
The court upheld the claim and ordered the Zhanaozen housing and utilities department to reinstate the man in the queue with the original registration date — 7 December 2009.
