A court in Taraz has ordered a security agency to compensate for a dismantled vehicle on a special parking lot, the Zhambyl Regional Court reported. This was reported by Qazaqyia.kz citing Sputnik Kazakhstan.

In 2015, by a court decision, a Volvo FH12 truck belonging to the plaintiff was levied to fulfill credit obligations. In 2017, the vehicle was seized by a bailiff and placed under the custody of the security agency.

"After more than 7 years of storage, inspection revealed that the vehicle had become completely unusable: its main components and parts were stolen, and the vehicle itself was completely dismantled," the statement said.

The plaintiff reported that due to inadequate security, the value of his vehicle, previously set by the court at 9.6 million tenge, dropped to 992,000 tenge.

The defendant disagreed with the claim, stating that in 2019 the property was transferred to another security organization. However, documents confirming this, including acceptance certificates, were not submitted to the court.

The court found that, according to the law, the LLC was obliged to ensure the safety of the vehicle and return it in the condition it was received. Since the defendant could not prove its innocence in the theft of vehicle parts, the plaintiff's claims were deemed justified.

"By the decision of the Taraz City Court, more than 8.6 million tenge in material damages, as well as costs for property assessment and state duty, were recovered from the security agency in favor of the plaintiff," the regional court said.

The defendant appealed the decision, but the civil panel of the court agreed with the conclusions of the first instance and upheld the decision. The court acts have entered into legal force.
