Senators approved the law "On Amnesty in Connection with the Adoption of the New Constitution of the Republic of Kazakhstan." This was reported by Qazaqyia.kz citing Sputnik Kazakhstan.
The law defines categories of cases subject to termination and release from punishment. For a number of categories, the term of punishment will be reduced. It should be especially noted that administrative amnesty is being carried out for the first time in the country's history, said Senate Speaker Maulen Ashimbayev.
According to the law, full exemption from administrative punishment in the form of a fine is provided for citizens. These include: individuals who are citizens of Kazakhstan; individual entrepreneurs; private notaries; private bailiffs; lawyers and legal consultants. Administrative amnesty does not apply to fines imposed by the court, as well as fines for offenses that threaten the security of citizens and the state.
Approximately 1 million people fall under administrative amnesty. Criminal amnesty applies only to crimes that do not pose a serious threat to the security of citizens and the state. These include: criminal misdemeanors and minor crimes; crimes of medium gravity that did not cause harm or fully compensated for the harm caused. For grave and especially grave crimes, a reduction of the unserved sentence is provided. However, persons who have committed especially dangerous crimes are not subject to amnesty.
The final decision on amnesty for each convict is made by the court individually. According to the Ministry of Internal Affairs, 15 thousand people fall under criminal amnesty. Of these, 5 thousand are in prison, the rest are under probation supervision. It is worth noting that the peculiarity of the upcoming amnesty compared to previous humanitarian measures is that for the first time in Kazakhstan, administrative amnesty is being carried out simultaneously with criminal amnesty.
