The military court of the Semey garrison sided with a serviceman who was denied monetary compensation. This was reported by Qazaqyia.kz citing Kursiv Media.
The reason for the refusal was that part of his service was in military investigative units of the Ministry of Internal Affairs.
Service history
The man served in the military investigative department of the State Investigative Committee for the Taldykorgan garrison from July 1996 to November 1997. Then, until July 1999, he served in the military investigative bodies of the Ministry of Internal Affairs of Kazakhstan.
Attempt to obtain compensation
In April 2026, he filed a report requesting monetary compensation. The housing commission refused him, considering that service in the State Investigative Committee and military investigative units of the Ministry of Internal Affairs is law enforcement and not part of the Armed Forces.
Court decision
During the case review, the court indicated that the law "On Defense and the Armed Forces of the Republic of Kazakhstan" classifies the military investigative bodies of the Ministry of Internal Affairs as other troops and military formations.
"From the meaning of this norm of the law, it follows that other troops and military formations include the military investigative bodies of the Ministry of Internal Affairs of the Republic of Kazakhstan," the Military Court reported.
As a result, the decision of the housing commission was declared illegal. The defendant was obliged to pay the serviceman monetary compensation.
The court decision has not yet entered into legal force.
Earlier, Kursiv reported on a female serviceman whose housing payments were stopped after she asked to recalculate them due to the birth of a child. The woman went to court, which found the military unit's decision unreasonable and ordered payments to continue taking into account the changed family composition.
