A person serving a sentence in a penal system institution, together with accomplices at liberty, engaged in extortion. This was reported by Qazaqyia.kz citing Sputnik Kazakhstan.
Crime committed from prison
While in prison, L., together with accomplices at liberty, extorted money from two victims at a sauna in the city of Petropavlovsk. He participated in the crime via video link.
"It was established that a number registered under the name 'Sasha' in another accomplice's phone belongs to L., as well as correspondence between them. The correspondence discussed the circumstances of the crime, attempts to hide its traces, and the transfer to L. of part of the money obtained through crime," the court says.
Evidence confirmed
Data from the mobile operator confirmed that the said number belongs to L. And data from the base station showed that on the day of the crime the phone was located in the territory where the institution in which L. was serving his sentence is located.
The victims, who were subjected to pressure, took out bank loans in the amounts of 300,000 and 145,000 tenge.
Sentence term
"The court of first instance imposed on L. a sentence of 3 years of imprisonment for extortion. However, the final sentence term amounted to 8 years. The reason is that he committed the new criminal offense while serving a sentence of 21 years 9 months of imprisonment under the 2011 verdict," the cassation court says.
