A resident of Pavlodar region won a court case to recover the full cost of a Jennifer Lopez concert ticket. The seller refused to refund the full amount, but the appellate court ruled in favor of the buyer. This was reported by Qazaqyia.kz citing Kursiv Media.
The Kazakhstani citizen was assisted by specialists from the Department of Trade and Consumer Rights Protection of Pavlodar region.
According to case materials, the ticket was purchased through a travel agency. However, after payment, the buyer did not receive a contract, a cash receipt, or the ticket itself. Later, he canceled the purchase and demanded a refund. The seller agreed to return only part of the amount, withholding 30% — 113,061 tenge.
The court of first instance initially ordered the seller to return only part of the money, considering the dispute related to tourism services.
"In the court of first instance, the seller argued that the dispute arose within the framework of tourist services, since the ticket was purchased through a travel agency, and asked to apply the provisions of the Law of the Republic of Kazakhstan 'On Tourist Activities.' The court agreed with this position and partially satisfied the claim, awarding 263,809 tenge to the consumer, refusing to recover the withheld amount of 113,060 tenge," the department explained.
However, the appellate court concluded that no contract for a tourist product was concluded between the parties, and the matter concerned solely the purchase of a concert ticket.
"The legal relations of the parties are regulated by the norms of Chapter 33 of the Civil Code of the Republic of Kazakhstan on paid services, not by the Law 'On Tourist Activities,'" the court decision stated.
Furthermore, the seller could not document that they actually incurred expenses that would justify withholding more than 113,000 tenge.
"The conditions for withholding 30% of the service cost were communicated to the consumer only after payment was made, and therefore they cannot be considered agreed upon by the parties," the court noted.
As a result, the appellate panel ordered the seller to return the full cost of the ticket — 376,869 tenge — and also reimburse court costs.
The Department of Trade and Consumer Rights Protection reminded that before a purchase, the seller is obliged to provide complete information about the terms of purchase and return of tickets. Buyers are advised to use the services of official ticket operators and keep receipts, invoices, electronic tickets, and correspondence — they may be needed to protect their rights.
