Court Proceedings
During the court hearing, the defendant fully admitted her guilt, expressed readiness to publicly apologize, and partially agreed with the civil claim. However, the victim Zh. refused to forgive the offender, demanding a strict punishment under the law, as well as compensation for moral damages and coverage of court costs.
Sanction of the Article
The sanction of Article 131, Part 2 of the Criminal Code of Kazakhstan provides for a fine of up to 200 MCI, correctional labor, or involvement in community service for up to 180 hours.
Verdict
Given the admission of guilt, remorse, and lack of prior convictions, the court sentenced citizen L. to a fine of 30 MCI (129,750 tenge).
However, the defendant was saved from actually paying the main punishment by an amnesty.
The court act has not yet entered into legal force and may be appealed by the parties in accordance with the established procedure.
