Astana's specialized interdistrict court for administrative offenses arrested a man for 10 days for using obscene language during a TikTok live stream. The court ruling has not yet entered into legal force. This was reported by Qazaqyia.kz citing Kursiv Media.
According to the court, the incident occurred on November 7 at around 00:30. The man joined a city resident's live stream on TikTok and began using obscene language. The court regarded this as a display of disrespect toward others and a violation of public order.
The man's guilt was confirmed by an administrative offense protocol, his own admission statements, a police inspector's report, the victim's explanations and a video recording of the live stream.
The man's actions were classified as petty hooliganism under Part 1 of Article 434 of the Administrative Code of the Republic of Kazakhstan. This article provides for a fine of 20 monthly calculation indices (MRP), community service from 20 to 60 hours, or administrative arrest for 5–10 days.
The court took into account that the man admitted guilt and committed the offense for the first time. No aggravating circumstances were established.
When choosing the punishment, the court also took into consideration the nature of the offense and the demonstrative disregard for generally accepted norms of behavior. As a result, the man was given the maximum administrative arrest term provided for by this article – 10 days.
Earlier, Kursiv wrote about how a stand-up comedian was held accountable for obscene language during his performance – he was fined 86,500 tenge.
