A court in the Akmola region has declared the results of a school meal organization competition invalid after finding that the winner provided false information about its employees. This was reported by the regional court's press service. This was reported by Qazaqyia.kz citing Kursiv Media.
The case was initiated by a lawsuit from an individual entrepreneur against one of the schools in Atbasar. The entrepreneur challenged the results of the competition, which was won by the peasant farm "T."
According to the court, the farm claimed to have four chefs, attaching documents confirming employment relationships to its bid. However, during the trial, this information raised doubts.
To verify the data, the court summoned the mentioned employees for questioning. It turned out that one of the claimed chefs is a person with a disability who had never worked at the farm and was not acquainted with its management.
Another woman stated that she had indeed helped the farm, but no official employment contract was signed with her. The whereabouts of the other two claimed workers could not be determined.
The court also requested information from the Unified Accumulative Pension Fund JSC and state bodies. According to the data received, the peasant farm had not made pension contributions for the mentioned workers.
Additionally, the Department of the State Labor Inspection Committee reported that employment contracts with these individuals were not registered in the Unified System for Recording Employment Contracts (ESUTD).
Based on this information, the court concluded that the farm had provided false data on human resources, as well as forged documents regarding pension payments and registration of employment relations.
The court's decision declared the protocol on the competition results illegal and annulled it.
Furthermore, the court issued a special ruling to the prosecutor's office of the Akmola region. The supervisory authority is to provide a legal assessment of the actions of the head of the peasant farm, related to the possible use of forged documents and personal data of third parties without their consent.
The court acts have not yet entered into legal force.
