A cassation court in Almaty has reviewed a case where a daughter sought to evict her biological father from her home. This was reported by Qazaqyia.kz citing Sputnik Kazakhstan.
The apartment is registered in the plaintiff's name. She filed a lawsuit demanding her father's eviction.
The court of first instance granted her claim. However, the appellate court overturned that decision and refused to evict the man.
The reason: according to Article 68 of the Law "On Housing Relations," family members of the property owner have the right to use the dwelling on an equal basis with the owner. The man has been living in his daughter's apartment since September 2022.
During this time, the owner raised no objections to his residence. Disagreeing with the appellate ruling, the plaintiff appealed to the cassation court.
However, the cassation court upheld the previous decision, leaving the appellate ruling unchanged.
